Your sole remedy for any breach or default of this Agreement by www.MarexServices.com or MS shall be a return of any fees paid to www.MarexServices.com or MS for any services provided under this Agreement. Opinions, advice, statements, or other comments should not necessarily be relied upon and are not to be construed as professional advice from www.MarexServices.com or MS. www.MarexServices.com and MS do not guarantee the accuracy or completeness of any of the information provided. MS, its and their officers, employees, agents, affiliates, insurer, licensees and web hosting service vendors are not responsible for any loss resulting from your reliance on such information. MS relies upon the accuracy of the information provided from its users, including vessel owners and service providers.
4. Warning re: Offensive Information. It is possible that other www.MarexServices.com clients will post or send obscene or offensive materials on the site or to you via e-mail. Except for any information that is in the public domain, you are not authorized to reproduce, transmit or distribute the proprietary information of www.MarexServices.com and MS. By posting information to www.MarexServices.com and MS you represent that you have the right to grant permission for use by www.MarexServices.com and MS.
9. No Warranties. www.MarexServices.com and MS provide the www.MarexServices.com services on an“as is” basis and do not make any warranty, express, implied, limited, or other with respect to the services provided and the veracity of any information provider from other users and vessel owners/operators. Specifically, www.MarexServices.com and MS do not warrant that the service will always be available, be uninterrupted, be error free, meet your requirements, or that any defects in the services will be corrected. www.MarexServices.com and MS further disclaim any warranty of fitness of any vessel mentioned or advertised on www.MarexServices.com.
10. Data Processing. To the extent that MS determines it necessary and may be considered a “Controller” of data belonging to any MS user that is located in the European Economic Area, MS may utilize the services of a third-party Processor (as defined in Regulation 2016/679 of the European Parliament). Further, MS and/or a Processor may be required to transfer personal information to countries outside the EEA. Countries outside the EEA may not provide an adequate level of protection for your personal information. Accordingly, Users located in the EEA assume such risks by utilizing MS’s services on www.MarexServices.com. You may request that MS not transfer such information or utilize the services of a Processor. However, please note that such requests may result inability to use MS services on www.MarexServices.com. Please send any requests to MS to PRIVACY@MarexServices.com.
11. Jurisdiction. This Agreement or any dispute arising from this Agreement is governed by the laws of the state of Louisiana, without regard to provisions of conflicts of law. Any lawsuit arising from or related to this Agreement shall be brought exclusively before the United States District Court for the Middle District of Louisiana and you hereby consent to the jurisdiction of any such court.
12. Severability. If any provision is found to be invalid, the remaining provisions will be in full force and effect.
13. Certification. You certify that you are at least 18 years of age and that your answers to the registration materials on www.MarexServices.com will be truthful. In accessing and using www.MarexServices.com, you understand and agree that basic information concerning you, given to www.MarexServices.com, will be published on the MS for others to view along with your User ID. Your name, address and e-mail address are kept confidential, except where provided above.
